Allpayments Terms & Conditions

1. Application of terms and conditions (hereafter also referred to as “T&Cs”)
1.1 This page sets out the terms and conditions under which you can make payments through the allpayments internet payment facility on our website (“Facility”) or via the allpayments mobile application (“App”). Please read these terms and conditions carefully before using the Facility or App.
1.2 By clicking the “I accept” button when requested, you are confirming your agreement to these terms and conditions. If you do not agree to these T&Cs, you should not click the “I accept” button and you should not use the Services.
1.3 In these terms and conditions, reference to “we”, “our” or “us” is reference to allpay Limited. Reference to “you” and “your” is to you, the person using our Services. Reference to “Services” are to the services made available through the Facility or App.
1.4 We reserve the right to make changes to these terms and conditions from time to time and you should check this page each time you use the Facility or App.
2. Information about us
2.1 We are allpay Ltd a company incorporated in England and Wales with company number 02933191 and whose registered office address (and trading address) is at Fortis et Fides, Whitestone Business Park, Whitestone, Hereford HR1 3SE. Our telephone number is 0330 135 9512. Our VAT number is 459 5179 47.
2.2 We are fully compliant with the Payment Card Industry Data Security Standard (“PCI DSS”).
3. Use of our payment facility
3.1 You can use the Facility or App to make payments to any of your payment accounts which are registered with us (meaning you can make payments to organisations, only where those organisations are also registered with us).
3.2 Online payments can be made by debit or credit card. You can see which payment cards you have saved by consulting the “wallet” page on the Facility or App.
3.3 We will not charge you any administration fee for using the Facility or App to make any payment.
3.4 All intellectual property rights in the Facility and the App throughout the world belong to us (or our licensors). You must not use the Facility or the App in any unlawful manner or for any unlawful purpose.
3.5 If you download onto or access the App onto any phone or other device not owned by you, you must have the owner’s permission to do so. You will be responsible for complying with these terms, whether or not you own the phone or other device.
3.6 From time to time we may automatically update the App and change the Services to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App and the Services.
3.7 We may end your rights to use the Facility, the App and/or Services at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right we will give you a reasonable opportunity to do so.
4. Making payments
4.1 You must use your unique payment reference number (“PRN”) when making a payment. Please take care that the information you enter is correct. You can cancel any payment at any time up until you press the button that confirms payment.
4.2 You must keep all PRN numbers and your online username and password secret.
4.3 You must not use any debit or credit card to make a payment through the Facility or App unless you are the account holder or you have authority from the account holder to do so. If we suspect that you are using any payment card fraudulently, we reserve the right to pass your information on to the applicable law enforcement agency without notice to you.
4.4 Card payments are typically processed within one to two business days after you make a payment using our Facility or App. However, processing times may vary depending on your card issuer and the time and date of the transaction.
5. Confirmation of payment
5.1 Once your payment has been authorised, a confirmation screen will be displayed showing the payment details and a transaction reference number. These details will also be e-mailed to the email address you provided when you set up your allpayments account (so you need to make sure that you keep this email address up to date).
5.2 Please keep a note of the transaction reference number, as you will need to quote this if you have any queries with your payment.
5.3 Please note that under the Payment Services Directive, a payment is deemed to be received at the time the payment order is received by the payer’s payment service provider.
6. Refunds
6.1 If you make a mistake in any payment, you should contact our Customer Account Support team immediately via the contact details on the Contact page on the allpay website (https://www.allpay.net/contact/). You will need to have the payment reference number (PRN) and payment card details to hand. Please note that our opening hours are stated on our Contact page;
6.2 We may issue you with a refund for a transaction only where we are at fault. Should you make a mistake in any payment (such as making an overpayment for example), we will refer you to the organisation to whom you made the payment to resolve the matter;
6.3 If you request a chargeback from your card issuer, or if the bank or your payment card provider confirms that an unauthorised payment has been made using your card, will take steps to process the chargeback or refund the unauthorised payment;
6.4 All refunds will be made to the payment card which you used to make the payment. We aim to process refunds within 30 days;
6.5 if a refund is incorrectly issued to you, the organisation from whom you incorrectly received the refund may contact you to resolve the matter.
7. Security
7.1 We may store your payment card details solely for the operation of the Facility or App. Other than as necessary to process your payment and deal with any queries regarding the same, we will not share your payment card details with any third party or make them visible or accessible outside the secure banking network.
7.2 We will always take care to ensure your payment card details are kept safe and secure, in accordance with the PCI DSS. Your card details will be stored on a server behind a secure firewall, and only a limited number of authorised employees will be able to access this information.
7.3 We will use any personal information which you provide to us in accordance with our privacy policy https://www.allpay.net/policies.
8. Disclaimer of Liability
8.1 Save as prohibited by law, in no event will we be liable for any damages whatsoever arising out of your use, inability to use, or the results of use of theis Facility or the App, this website or any websites linked to it, or the materials or information contained at any or all such websites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
8.2 We do not accept liability for a payment not reaching the correct account due to you quoting an incorrect PRN or account number or incorrect personal or card details.
8.3 If your payment card provider or bank declines any payment, the account to which you wanted to make a payment will not be credited and we are under no obligation to bring this fact to your attention. We do not accept liability if any payment is refused or declined by your payment card provider or bank for any reason. You should check with your bank or payment card provider that payment has been deducted from your account. If your payment is refused you will need to contact your payment card provider or bank to discuss the reasons for the refusal and make alternative arrangements to make payment to the account you wish to pay.

10. Governing Law
10.1 These terms and conditions, their subject matter and their formation, are governed by English and Welsh law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
